1. Preamble and purpose

These Terms of Use (hereinafter the "Terms") govern access to and use of the CRS Report platform, accessible at https://crs-report.com (hereinafter the "Platform" or the "Tool").

CRS Report is a digital surgical-documentation aid, designed by and for surgeons, allowing the structuring, harmonisation and standardisation of cytoreductive surgery (CRS) reports and the assessment of the extent of peritoneal disease (Peritoneal Cancer Index calculation, description of peritonectomy procedures, visceral resections, surgical resection scores, etc.).

The Platform is published and administered under the direction of Mr Laurent VILLENEUVE, Research Unit 3738 CICLY (hereinafter the "Publisher"). Its design and maintenance are provided by MARIUS CHALUMEAU EIRL – UINNOV.

Access to and use of the Platform imply full and unreserved acceptance of these Terms.

2. Definitions

  • User: any healthcare professional, and more particularly any surgeon, accessing the Platform and using it in the course of their activity.
  • Report: a structured operative document generated by the Platform from the data entered by the User.
  • Data: all information entered, processed or exported via the Platform (.pdf, .csv, .json formats).

3. Acceptance and modification of the Terms

Use of the Platform constitutes unreserved acceptance of these Terms. A User who does not accept all or part of the Terms must refrain from using the Platform.

The Publisher reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date of use. It is the User's responsibility to consult the most recent version regularly.

4. Description and purpose of the Tool

CRS Report provides computer assistance intended to produce standardised elements relating to the extent of peritoneal metastases and to cytoreductive procedures. These elements may subsequently be used by the persons concerned to draft operative reports. To this end, the Tool notably enables:

  • the mapping of lesions and the automatic calculation of the Peritoneal Cancer Index;
  • the structured description of the surgical procedures performed (peritonectomies, visceral resections, lymph node dissections, HIPEC, PIPAC, etc.);
  • the automatic calculation of surgical scores;
  • the generation and export of structured data.

5. Nature of the Tool — Essential medical disclaimer

CRS Report is exclusively a documentation and standardisation aid. It constitutes neither a diagnostic aid device, nor a therapeutic decision-support tool, nor a substitute for the clinical judgement of the healthcare professional.

Consequently:

  • The scores, calculations and data produced by the Platform are based exclusively on the data entered by the User and have only the value of a structured restitution of those entries.
  • Diagnostic, therapeutic and surgical decisions are the sole responsibility of the healthcare professional, who must exercise their clinical judgement independently of the Tool's outputs.
  • The User remains solely responsible for verifying, ensuring the accuracy of and validating the information contained in any report before its integration into the patient's medical record.
  • The Tool in no way replaces professional recommendations, care protocols or the User's ethical and regulatory obligations.

6. Access to the Tool and free of charge

Access to the Platform is free and open. No financial consideration is required from the User.

The Tool is intended for use by healthcare professionals in a professional context. The Publisher cannot be held liable for any use of the Platform by any unqualified person or outside the purpose described in article 4.

The Publisher endeavours to ensure the availability of the Platform but does not guarantee any continuity of service. Access may be suspended, limited or interrupted, in particular for maintenance, updates, or for any technical reason, without notice and without the Publisher's liability being engaged.

7. User obligations and responsibilities

The User undertakes to:

  • use the Platform in accordance with its purpose, these Terms, and the applicable laws and regulations;
  • enter only the data necessary for the purpose of the Tool and ensure their accuracy;
  • comply with their obligations regarding medical confidentiality and the protection of patients' personal data;
  • ensure the retention, security and fate of the reports and data they export;
  • not attempt to undermine the operation, security or integrity of the Platform.

Patient data: the User is solely responsible for the lawfulness of the data processing they carry out via the Tool, in particular compliance with the General Data Protection Regulation (GDPR) and the provisions applicable to health data. It is their responsibility to ensure that they have an appropriate legal basis and, more generally, to avoid entering directly identifying data where this is not necessary.

8. Data entered and confidentiality

The clinical data entered by the User are neither durably stored, archived nor analysed by the Publisher. They are not retained on the Platform's servers for subsequent use and are never shared with third parties.

Evaluation data and reports are processed only transitorily, solely for the operation of the service during the User's session, and are automatically deleted after no more than 20 minutes of inactivity. The corresponding technical cookie (evaluation_session) is deleted as soon as the evaluation ends or is reset. The exported reports and data (.pdf, .csv, .json formats) are placed under the sole responsibility of the User, who ensures their retention and security.

The arrangements relating to cookies, session management and audience measurement are set out in the Privacy Policy and the Cookie Management page, which form an integral part of these Terms.

9. Intellectual property

The Platform, its structure, interface, content, documentation, trademarks, logos and all the elements making it up are protected by intellectual property law and remain the exclusive property of the Publisher and/or its partners.

Any reproduction, representation, modification, extraction or exploitation, in whole or in part, without the prior written authorisation of the Publisher, is prohibited.

The reports and data generated from the information entered by the User remain the property of the User, who assumes responsibility for and use of them.

10. Limitation of liability

The Tool is provided "as is", without warranty of any kind, express or implied, as to its suitability for a particular use, the accuracy of the calculations returned or the absence of interruption or error.

Within the limits permitted by law, the Publisher cannot be held liable for:

  • the medical, diagnostic or therapeutic decisions taken by the User;
  • any error, omission or inaccuracy in the data entered by the User, or in the resulting reports;
  • any direct or indirect damage resulting from the use, unavailability or inability to use the Platform;
  • the loss of data exported or not retained by the User.

The professional liability relating to the act of care and the keeping of the medical record lies exclusively with the User.

11. Third-party links and services

The Platform may link to third-party sites or services (partners, audience-measurement tools, embedded content such as videos). The Publisher exercises no control over this third-party content and declines all responsibility in this respect.

12. Applicable law and competent jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or performance will, failing amicable resolution, be submitted to the competent French courts.
